Agreement to these terms
These Terms govern your use of Delia (“the App”), operated by Arshia Mashhadikordi (“we,” “us”). By using Delia, you agree to these Terms. The app license is also governed by Apple’s Standard End User License Agreement; Apple’s purchase terms apply to App Store transactions. These Terms supplement that license and do not reduce rights that cannot lawfully be excluded.
1. What Delia is
Delia creates personalized stories, visualizations, affirmations, images, and reflective journaling experiences for relaxation, motivation, and personal growth. Generated content may be inaccurate, incomplete, or similar to content generated for others. It does not guarantee real-world outcomes.
2. Not medical or professional advice
Delia is not a medical, psychological, therapeutic, financial, or other professional-advice service. It does not diagnose, treat, cure, or prevent a condition. Use qualified professional advice for decisions that require it. Do not use the App in a way that distracts from driving or other activities requiring attention.
3. Eligibility
You must be at least 13, or the higher minimum age required in your country, to use Delia. If you have not reached the legal age of majority, a parent or guardian must review these Terms and permit your use where required.
4. Free access, subscriptions, and purchases
- Delia 1.1 includes one complimentary story and free daily affirmations. You can close the paywall and browse the app. Additional stories require active subscription access or an applicable redeemed offer.
- Optional subscriptions are billed weekly or yearly through Apple. The localized price, billing period, and any offer terms are shown before you confirm with Apple. The Yearly plan currently has no standard introductory free trial.
- Paid subscriptions automatically renew unless cancelled at least 24 hours before the current period ends. Apple charges your Apple Account on confirmation and for subsequent renewals under the terms shown at purchase.
- Manage or cancel through Delia’s subscription controls or your Apple Account settings. Deleting the App, signing out, or deleting Delia data does not cancel a subscription. Restore Purchase checks for eligible Apple purchases; it does not restart expired access.
- Apple processes payments and refund requests. Refund eligibility is determined under Apple’s rules and applicable consumer law; these Terms do not remove statutory refund rights.
5. Invite rewards and offer codes
- An inviter can earn one seven-day free offer after two eligible friends enter that inviter’s code during setup and the invites are verified. Self-referrals, repeat sign-ups by the same participant, and automated or fraudulent referrals do not qualify. Reinstalling the App does not create another eligible referral.
- The seven-day invite reward renews as the Weekly subscription at Apple’s displayed price unless cancelled. Receiving the reward or a code does not itself activate access; Apple redemption and eligibility checks must complete.
- The public seven-day free offer renews as the Weekly subscription at Apple’s displayed price unless cancelled. It does not require inviting friends. A shared public code can be used by multiple eligible customers, with one redemption per customer for the offer; Apple enforces its redemption limit.
- The two-month free offer is configured not to automatically renew at the end of its offer period. If you already have a subscription, review Apple’s redemption screen and your subscription settings to understand how the offer applies; it is not a promise of a refund or cancellation of another subscription.
- Offers depend on available codes, campaign limits, expiry dates, and Apple’s account and storefront eligibility rules. A campaign code entered in Delia can be exchanged for an assigned single-use Apple code and opened in Apple’s redemption flow. Codes have no cash value, and sharing an assigned code does not create additional redemptions.
- A public offer link can automatically reserve a single-use Apple code and open Apple’s redemption and download screen without the App installed. Reserving a code counts toward the campaign limit even if you do not finish redemption or download. Returning in the same browser normally reuses that assignment.
- We may stop distributing unused codes or reject invalid or abusive claims. Changes to future availability do not change access already validly redeemed with Apple.
6. Your content and privacy
You retain your rights in the personal content you provide. You give us and the providers described in our Privacy Policy permission to process that content as needed to operate requested features, including cloud generation and optional account restoration. You are responsible for having permission to upload reference images and information about other people.
Generated results are supplied for your use subject to applicable law and provider terms. We do not promise that a result is unique, eligible for copyright protection, or free of third-party rights. Review outputs before relying on or sharing them.
7. Acceptable use
Do not use Delia unlawfully, upload content you lack the right to use, interfere with service security, evade access or offer limits, or create fraudulent referrals. Restrictions on copying or reverse engineering apply only to the extent permitted by law and the applicable software license.
8. App ownership
The software, branding, design, and original materials we provide are owned by us or our licensors. Your right to use the App is a license under the applicable terms, not ownership of the software or our branding. This does not transfer ownership of the content you provide.
9. Availability and account data
Cloud generation, account restoration, purchases, and offer verification need access to their respective online services and may be interrupted or unavailable. Keep copies of content important to you. Sign in with Apple is optional; signing out retains an account archive, while Delete Delia Data can delete it when you are signed in. Other records, including offer and transaction records, are handled as described in the Privacy Policy.
10. Disclaimers and consumer rights
To the extent allowed by law, Delia is provided as available without a guarantee of uninterrupted service, error-free AI output, or a particular personal outcome. We are not responsible for indirect or consequential loss to the extent that such a limitation is lawful.
Nothing in these Terms excludes or limits liability, warranties, refunds, or other consumer rights that cannot legally be excluded or limited, including liability for fraud or death or personal injury caused by negligence where applicable.
11. Changes
We may update the App and these Terms. We will revise the date above and provide notice of material changes where required. Changes apply prospectively and do not remove accrued consumer rights or change an Apple transaction without the notices or consent required for that transaction.
